This document (as well as all other documents mentioned herein) regulates the conditions governing the use of this Website www.elserralet.com and the purchase or acquisition of products and/or services therein (hereinafter, Conditions).

For the purposes of these Terms and Conditions, it is understood that the activity carried out by EL SERRALET DE SEGÀRIA through the Website includes: Marketing and distribution of artisan honey and apitourism.

In addition to reading these Terms and Conditions, before accessing, browsing and/or using this website, the User must have read the Legal Notice and the General Terms and Conditions of Use, including the cookie policy and the privacy and data protection policy of EL SERRALET DE SEGÀRIA. By using this Website or by purchasing and/or requesting the purchase of a product and/or service through it, the User agrees to be bound by these Terms and Conditions and by all of the above, so if you do not agree with all of this, you should not use this Website.

Likewise, please note that these Terms and Conditions may be modified. The User is responsible for consulting them each time they access, browse and/or use the Website, as those that are in force at the time of requesting the purchase of products and/or services will be applicable.

2. THE USER

Accessing, browsing and using the Website confers the status of user (hereinafter referred to, interchangeably, individually as User or collectively as Users), and therefore, from the moment you start browsing the Website, you accept all the Conditions set out herein, as well as any previous modifications, without prejudice to the application of the corresponding mandatory legal regulations, as the case may be.

The User assumes responsibility for the proper use of the Website. This responsibility extends to:

  • Use this Website solely for making legally valid enquiries and purchases or acquisitions.
  • Do not make any false or fraudulent purchases. If it could reasonably be considered that such a purchase has been made, it may be cancelled and the relevant authorities will be informed.
  • Provide accurate and lawful contact details, such as your email address, postal address and/or other details (see Legal Notice and General Terms and Conditions of Use).
The User declares that they are over 18 years of age and have the legal capacity to enter into contracts through this Website.
3. PURCHASE OR ACQUISITION PROCESS
Duly registered Users may purchase on the Website by the established means and methods. They must follow the online purchase and/or acquisition procedure at www.elserralet.com, during which various products and/or services may be selected and added to the cart, basket or final purchase space and, finally, click on ‘FINALISE PURCHASE’.

Likewise, the User must fill in and/or check the information requested at each step, although during the purchase process, before making the payment, the purchase details can be modified.

The User will then receive an email confirming that EL SERRALET DE SEGÀRIA has received their order or request to purchase and/or provide the service, i.e. the order confirmation. Where applicable, they will also be informed by email when their purchase is being dispatched. Where applicable, this information may also be made available to the User through their personal space on the Website.

Once the purchase procedure has been completed, the User consents to the Website generating an electronic invoice that will be sent to the User via email. And, where applicable, through their personal space when logging into the Website.

4. AVAILABILITY
All purchase orders received by EL SERRALET DE SEGÀRIA through the Website are subject to product availability and/or to no circumstances or causes of force majeure affecting the supply of the same and/or the provision of services. If there are difficulties in supplying products or there are no products left in stock, EL SERRALET DE SEGÀRIA undertakes to contact the User and refund any amount that may have been paid. This shall also apply in cases where the provision of a service becomes impossible.
5. PRICES AND PAYMENT
The prices displayed on the Website are in Euros (the official currency in Spain), which will be the currency used for purchases on this Website and include taxes, unless otherwise indicated and applied by legal requirement, particularly with regard to VAT.

Under no circumstances will the Website automatically add additional costs to the price of a product or service, but only those that the User has voluntarily and freely selected and chosen.

Prices may change at any time, but any changes will not affect orders or purchases for which the User has already received an order confirmation.

The accepted payment methods are: Credit or debit card and Bizum.

EL SERRALET DE SEGÀRIA uses all means to ensure the confidentiality and security of payment details provided by the User during transactions via the Website.

Credit cards will be subject to checks and authorisations by the issuing bank. If the bank does not authorise payment, EL SERRALET DE SEGÀRIA will not be liable for any delay or non-delivery and will not be able to enter into any contract with the User.

6. SHIPPING COSTS AND DELIVERY TIMES

6.1. SHIPPING COSTS

Shipping and/or handling costs are not included in the price and will be shown to you before you complete your purchase.
For orders with a delivery address in mainland Spain and Andorra with a value of over €50 (including VAT), shipping will be free of charge for the User.
For orders within mainland Spain with a value of less than €90, the fixed cost will be €5.99.

The delivery time for products purchased at EL SERRALET DE SEGÀRIA will be approximately 48-72 hours from the time of payment, unless there is an incident, in which case the User will be notified.

6.2. SHIPPING METHOD AND DELIVERY TIMES
Products are shipped to the delivery address you provided in your order. If you are not at home, you also have the option of choosing to receive your order at Correos offices and CityPaq locations, as we collaborate with Correos Market, a platform that supports local commerce by giving local artisans and producers the opportunity to offer their products to users.
In the event that the User detects any problem at the time of delivery of their order (damaged packaging, missing or damaged products), they must indicate this in writing on the carrier’s delivery note and contact us by telephone on +34 696 352 903 within 24 hours of receipt. No returns of damaged items or claims for missing items will be accepted if they have not been reported within the established period. All of this is without prejudice to the warranty rights for products that do not comply with the contract, which are available to all consumers in accordance with current regulations.

However, you will have the option to track your order, as Correos will provide you with a tracking code so that you can stay up to date with the status of your order at all times.
7. WRITTEN COMMUNICATIONS AND NOTIFICATIONS


By using this Website, the User agrees that most communications with EL SERRALET DE SEGÀRIA will be electronic (e-mail or notices posted on the Website).

For contractual purposes, the User agrees to use this electronic means of communication and acknowledges that all contracts, notifications, information and other communications that EL SERRALET DE SEGÀRIA sends electronically comply with the legal requirements of being in writing. This condition shall not affect the rights recognised by law to the User.

8. PROTECCIÓN DE DATOS
Any personal information or data that the User provides to EL SERRALET DE SEGÀRIA during a transaction on the Website will be processed in accordance with the provisions of the data protection policies (Legal Notice and General Conditions of Use). By accessing, browsing and/or using the Website, the User consents to the processing of such information and data and declares that all the information or data provided is accurate.
9. SALES, CANCELLATION AND RETURN POLICY
The products sold by EL SERRALET DE SEGÀRIA are entirely handmade, so their size, colour, or shape may differ slightly from those shown in the photographs advertised on the website, without this affecting their quality. Therefore, these photographs are for informational purposes only and are not contractually binding.
The User may only make a claim if:
• The products received do not correspond to the orders or the quantity does not correspond to the order, with the exceptions indicated, regarding the possibility of receiving partial orders in the event that any of the products requested are not in stock. (if the quantity or product appearing on the delivery note does not correspond to the quantity or product actually contained in the shipment, this must be communicated to the carrier, noting this circumstance on the delivery note itself).
• The packaging is seriously damaged, affecting the quality of the product (in this case, the carrier must be notified and this must be noted on the delivery note).
• The products are in poor condition upon receipt. In this case, you must send your complaint to EL SERRALET DE SEGÀRIA on the same day you receive the order.
Given the perishable nature of the products sold by EL SERRALET DE SEGÀRIA, it is very important that any complaints regarding the product purchased are processed as quickly as possible.
In the event that at least one of the above circumstances occurs, and provided that the customer has notified EL SERRALET DE SEGÀRIA on the day of receipt and, in the cases indicated, has noted this on the delivery note, the User shall be entitled to a refund of the price paid, including taxes and shipping costs. To this end, and where applicable, the order must be returned in its original packaging.
The refund will be made once EL SERRALET DE SEGÀRIA has verified the alleged defect, within a maximum period of 30 days. If, once returned, the products are found to be in good condition, the User will not be refunded the amount of the order and it may be re-shipped, provided that the User so requests and pays the shipping costs again. If only part of the products are defective, only the part of the price corresponding to that product will be refunded, but not the shipping costs, which are fixed in all cases.
If the shipment is rejected by the User or the User fails to collect it without just cause, EL SERRALET DE SEGÀRIA shall be exempt from liability for any damage that the product may suffer as a result of such failure to receive it, and shall not be obliged to refund any amount.
If, despite there being no quality defects, the User states that they are not satisfied with the product and provided that it is the first time they have ordered it, they may request a refund from EL SERRALET DE SEGÀRIA, which will be made within a maximum period of 30 days.
9.1. In accordance with the provisions of Law 7/1996, of 15 January, on Retail Trade Regulation, we hereby inform you that:
(a) podrás ejercitar tu Derecho de Desistimiento al Pedido dentro de los catorce (14) días hábiles desde su contratación, de acuerdo a lo dispuesto en el artículo 44 de dicha ley; salvo en caso de que aplique alguna excepción
(b) EXCEPTIONS:
1. If the product is not in perfect condition.
2. If the product packaging is not the original packaging or is not in perfect condition. The original packaging must protect the product so that it is received in perfect condition. The use of seals and adhesive tape applied directly to the packaging is prohibited.
3. When the product has been opened and it cannot be proven that it has not been used.
4. When products are customised to your needs or for reasons of hygiene or other exceptions legally provided for in Article 103 of Law 3/2014 of 27 March, in particular, it shall not apply to contracts relating to: […] “h) the supply of alcoholic beverages whose price has been agreed at the time of conclusion of the sales contract and which cannot be delivered before 30 days, and whose actual value depends on market fluctuations that the trader cannot control”.
9.2. Returns
In the event of withdrawal from the purchase of physical products, returns shall be sent to EL SERRALET DE SEGÀRIA by the same means by which they were delivered, and the shipping costs shall be borne by the User. Likewise, EL SERRALET DE SEGÀRIA shall refund the corresponding amounts by the same means by which they were paid.
9.3. Refund and/or cancellation policy for apitourism activities
If the User wishes to cancel the apitourism activity, a refund may be issued or, if the User so requests, the date of the activity may be changed. If the User is unable to attend and gives notice forty-eight (48) hours or less in advance, the booking fee will not be refunded. The company therefore reserves the right to cancel and/or postpone an activity due to weather conditions or other justified reasons.
